In these Terms and Conditions, the following terms shall have the following meanings:
1.1 Additional agreement: an agreement in which the Consumer acquires products, digital content and/or services with respect to a distance agreement and these goods, digital content and/or services are delivered by the Webshop or a third party on the basis of an arrangement between this third party and the Webshop;
1.2 Reflection period: the period during which the Consumer may use his right of withdrawal;
1.3 Consumer: the natural person who does not act for purposes related to his/her commercial, trade, craft or professional activities;
1.4 Day: calendar day;
1.5 Digital content: data produced and delivered in digital form;
1.6 Continuing performance contract: a contract serving to deliver goods, services and/or digital content in a given period;
1.7 Sustainable data carrier: any means, including email, that allow the Consumer or the Entrepreneur to store information directed to him/her personally in such a manner that makes future consultation and use possible during a period that matches the purpose for which the information is destined and which makes unaltered reproduction of the stored information possible.
1.8 Right of withdrawal: the Consumer’s option not to proceed with the distance agreement within the cooling-off period;
1.9 Webshop: HUB Footwear who provides products, (access to) digital content and or services to Consumers at a distance;
1.10 Distance contract: a contract concluded by the Webshop and the Consumer within the scope of an organised system for distance selling products, digital content and/or services, whereby exclusive or additional use is made of one or more technologies of distance communication up to the conclusion of the contract;
1.11 Standard form for withdrawal: the European standard form for withdrawal included in Appendix 1;
1.12 Technology for distance communication: a means to be used for concluding an agreement without the Consumer and the Webshop being together in the same place at the same time.
2.1 These General Terms and Conditions apply to any offer from the Webshop and to any distance contract concluded by the Webshop and the Consumer.
2.2 In the event that specific product or service condition apply in addition to these General Terms and Conditions, the second and third paragraphs shall apply accordingly.
2.3 We may revise these terms and conditions from time to time.
2.4 The revised terms and conditions shall apply to the use of our website from the date of publication of the revised terms and conditions on the website, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions.
2.5 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
2.6 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
3.1 Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
3.2 We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
3.3 We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
4.1 The Consumer can repudiate a purchase contract for a product for a period of refelction of 15 days. After these 15 days, unfortunately we cannot offer you a refund or exchange.
4.2 The reflection period referred to in sub-clause 1 starts on the day the product is received by the Consumer or by a third party appointed by him in advance and who is not the carrier, or:
a. if the Consumer ordered several products in the same order: the day on which the Consumer or a third party appointed by him received the last product. The Webshop may refuse an order of several products with different delivery dates provided that he clearly informs the Consumer prior to the order process.
b. In case the delivery of a product consists of several batches or parts: the day on which the Consumer or a third party appointed by him received the last batch or the last part.
c. in case of an agreement about regular delivery of products during a given period: the day on which the Consumer or a third party appointed by him received the first product.
4.3 During the reflection period, the Consumer shall handle the product and the packaging with care. The Consumer shall only unpack or use the product to the extent necessary for establishing the nature, the characteristics and the effect of the product. The Consumer may only handle and inspect the product in the manner in which one is allowed to handle a product in a shop.
4.4 If any item is not in its original condition, is damaged, has missing parts for reasons not due to the Webshop’s error, or is returned more than 15 days after delivery, we hold the right to give a partial or no refund at all. The Consumer will be liable for the decrease in value of the product that is caused by handling the product in any other way or by any other means than described in article 4.3. The Consumer will also be liable for any damages to the product caused by wrongly packaging of the product when returning the product.
4.5 Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
4.6 If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at [email protected].
4.7 We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at [email protected] and send your item to: Saturnusstraat 60 - Unit 75 (street) 2516AH (postcode) The Hague (city) The Netherlands (country).
4.8 Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
4.9 If the Consumer returns the product within the reflection period referred to in sub-clause 1, the Webshop will return the standard delivery charges the Consumer might have made when the Webshop sent the Consumer the product. Take note if the Consumer returns the Order partially, the Consumer might not be eligible to receive a refund for the standard delivery charges. Return costs shall be bore by the Consumer, the Webshop does not offer a refund for the return costs.
5.1 If the Consumer exercises his right of withdrawal, he shall notify the Webshop unambiguously with the standard form for withdrawal or by sending an e-mail to se[email protected], within the period of reflection (15 days).
5.2 The Consumer shall return the product or deliver it to the Webshop as soon as possible but within 14 days counting from the day following the notification referred to in article 5.1.
5.3 The Consumer shall return the product with all delivered accessories and in the original state and packing and in conformity with reasonable and clear instructions given by the Webshop.
5.4 The risk and the burden of proof for the correct and timely exercise of the right of withdrawal fall on the Consumer
5.5 You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
5.6 If you are shipping an item over 75€, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
The Webshop excludes the following products and services from the right of withdrawal:
6.1 Products or services with a price that is subject to fluctuations in the financial market on which the Webshop has no influence and which may occur within the period of withdrawal;
6.2 Agreements that are concluded during a public auction.
6.3 Services agreements, after full performance of the service, but only if
a. the performance started with the Consumer’s explicit prior consent; and
b. the Consumer stated that he will lose his right of withdrawal as soon as the Webshop has fully performed the agreement.
6.4 Products manufactured in accordance with the Consumer’s specifications which are not prefabricated and which are produced on the basis of a Consumer’s individual choice or decision or which are intended for a specific person;
6.5 Perishable products or products with a limited durability.
6.6 Sealed products which are for health or hygiene reasons not suitable for being returned and of which the seal was broken
6.7 Products which for their nature are irreversibly mixed with other products.
7.1 The Webshop shall exercise the best possible care when booking orders and executing product orders and when assessing requests for the provision of services.
7.2 The place of delivery is at the address given by the Consumer to the Webshop.
7.3 The Webshop shall execute accepted orders with convenient speed but at least within 30 days, unless another delivery period was agreed on. If the delivery has been delayed, or if an order cannot be filled or can be filled only partially, the Consumer shall be informed about this within one month after ordering,
7.4 The risk of loss and/or damage to products will be borne by the Webshop until the time of delivery to the Consumer or a representative appointed in advance and made known to the Consumer, unless explicitly agreed otherwise.
8.1 You may register for an account with our website by completing and submitting the account registration form on our website, and clicking on the verification link in the email that the website will send to you.
8.3 You must notify us in writing immediately if you become aware of any unauthorised use of your account.
8.3 You must not use any other person's account to access the website, unless you have that person's express permission to do so.
8.4 The email address you provide for order processing, will only be used to send information and updates pertaining to your order. It may also be used to respond to your inquiries, and/or other requests or questions.
8.5 If you decide to opt-in to our emailing list, you will receive emails that may include company news, updates, related product or service information, etc. If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or you may contact us via our website.
9.1 If you register for an account with our website, you will be asked to choose a user ID and password.
9.2 Your user ID must not be liable to mislead and must comply with the content rules set out in Section 10; you must not use your account or user ID for or in connection with the impersonation of any person.
9.3 You must keep your password confidential.
9.4 You must notify us in writing immediately if you become aware of any disclosure of your password.
9.5 You are responsible for any activity on our website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.
9.6 You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
10.1 We may:
(a) suspend your account;
(b) cancel your account or order; and/or
(c) edit your account details,
at any time in our sole discretion without notice or explanation.
10.2 You may cancel your account on our website using your account control panel on the website.
11.1 If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
11.2 We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.
11.3 You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party
12.1 These Terms and Conditions, together with our privacy and cookies policy, shall constitute the entire agreement between you and us in relation to your use of our website and shall supersede all previous agreements between you and us in relation to your use of our website.
13.1 Contracts between the Webshop and the Consumer, to which these General Terms and Conditions apply, are exclusively governed by Dutch law.
13.2 Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of The Netherlands and/or Europe.
